By using our Website and its related services, you hereby provide your informed consent to the collection, process and use of your Personal Information by Spikerz and any third-party on its behalf (including the transfer of such Personal Information to third parties, as set forth in the Privacy Policy), all, for the purposes and the terms set forth in this Privacy Policy.
3.3. Information from Social Media Platforms. When you use features of our Website that integrate social media platform's API, including: YouTube API Services, Meta API (Instagram, Facebook, etc), LinkedIn API, Twitter / X API, TikTok API, we may collect information that you have made available through your social media account. This may include your username, channel information, and content data. Such social media feature is hosted by a third-party. Your interactions with this feature are governed by the privacy policy and terms of use of the social media platform providing it and you should read these documents carefully before you submit any Personal Information to these platforms.
The types of Personal Information each User is required to provide or which we collect include the following:
4.1. Personal Information provided directly by Users through the Website. The types of Personal Information each User will be required to provide include the following:
4.1.1. Contact us: when you choose to contact us and fill in the form on the Website, you will have to provide your full name, email address, category of request and any other free content you will choose to share with us (such as your social media profile).
4.1.2. Talk to Sales: when you choose to talk to sales and fill in the form on the Website, you will have to provide your full name, email address and select a date and time to meet with our team. The provision of certain types of Personal Information may be necessary or optional, depending on your requests. Mandatory data will be marked as such at the moment of collection of your Personal Information. If you refuse to provide mandatory Personal Information, Spikerz may not be able to process your request (e.g., reply to your contact request).
4.2. Personal Information provided by Users through our online payment form: 4.2.1. Registration and purchase: if you choose to purchase our Services, you will have to provide your first and last name, telephone number and email address, and details of credit card. We accept certain online payment methods, using online payment processors. These online payment processors will collect your Personal Information required to complete your purchase. We are not affiliated with such online payment processors as each is an independent contractor, and the collection and use of any Personal Information by such online payment processors is subject to their privacy policy and terms of use. We will only receive from such online payment processors an indication for the payment.

5.1. Operating the Website, such as providing access to and enable interaction with the Website and its related services - The EU legal basis is performance of the contract between Spikerz and the Users (i.e., Terms of Use);
5.2. Improving the Website and User’s experience, such as monitoring, analyzing and facilitating the use of the Website and your social media activity; developing and customizing the Website; improving the usefulness and quality of the Website; determining the effectiveness of our Website; for commercial research and further development and creating aggregated statistical data – The EU legal basis is your consent obtained through our cookie banner;
5.3. Supporting and enhancing security of the Website, such as ensuring that the Website is functioning correctly and to monitor, investigating any bug with, and preventing and mitigating the risks of fraud, error or any illegal or prohibited activity, providing technical support, preventing and resolving technical administration and troubleshooting of the Website – The EU legal basis is legitimate interests of Spikerz to secure its Website and User’s experience;
5.4. Managing our commercial communications, such as adding you in our mailing list, sending you general or personalized service-related messages, and marketing and promotional communications regarding our services, and unsubscribing you from the list - The EU legal basis is your consent.
5.5. Managing the received requests through the ‘Contact Us’ forms, such as answering inquiries, questions and requests from Users, including, but not limited to, data subjects requests - The EU legal basis is legitimate interests of Spikerz in managing the received requests.
5.6. Managing any litigation, such as taking action against any identified security beach, seeking advice from lawyers, auditors and other professional advisers – The EU legal basis is legitimate interests of Spikerz in defending its rights and interests.
5.7. Complying with legal and regulatory obligations, such as enforcing this Privacy Policy, resolving disputes, comply with any applicable law, or other requests from authorized authority(ies), and/or as otherwise authorized by you – The EU legal basis is legal obligations to which Spikerz is subject.
6.1. Retention. We retain the User's Personal Information for as long as such individuals are using our Website and its related services, including until we have processed Visitor’s request contacting us. If a User ceases to use our Website and its related services, we may continue to retain certain Personal Information of that User for longer periods solely for the period required by legal and regulatory obligations to which we are subject to, including for accounting purposes (i.e., as required by applicable laws regulating our Website and its related services, for bookkeeping purposes, and in order to have proof and evidence concerning our relationship with that User, should any legal issues arise following the User’s discontinuance of use of our Website and its related services).

7.6. Sharing of Personal Information. For the purposes of the CCPA, in the preceding twelve (12) months, we have not shared your Personal Information for cross-contextual behavioral advertising.
We endeavor to maintain reasonable administrative, technical and physical safeguards designed to protect the Personal Information we maintain, in particular against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure, harm to the integrity, or use. Although we make reasonable efforts to protect the Personal Information which you provide to us, the transmission of Personal Information over the internet and storage on IT systems and cloud-based servers is not completely secure. As such, you acknowledge and accept that we cannot ensure the security of any Personal Information you transmit to us, or guarantee that this Personal Information will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures in the event of any compromise of Personal Information. 9.1. General Provisions. This section 9 outlines how we collect and use your Personal Information as part of our recruitment practices. Please note that this section 9 supplements the other sections of this Privacy Policy. Job opportunities are posted on our Website for your convenience but we do not collect any Personal Information related to your job application directly via our Website. However, when you choose to apply for a position, you will be redirected to our official LinkedIn© page. Please note that the collection and processing of your Personal Information in connection with your application will also be subject to the terms and privacy policy of LinkedIn©.
9.2. No Legal Requirement. For the avoidance of doubt, when you apply for a position, you agree to the processing of your Personal Information in accordance with the terms of this Privacy Policy. By submitting the Personal Information at your own free will, you agree that Spikerz will use it to assess your suitability for the position to which you have applied. You understand that without providing the Personal Information described in this section, we will not be able to review your application and/or contact you in order to give you details and/or provide you with a response regarding your application.
9.3. Personal Information Collection. We receive the following Personal Information from our LinkedIn© page:· Identification information, i.e., full name, · Contact details, i.e., email address, phone number, address· Professional information, i.e., resume, the position you are applying for.· Any other Personal Information you choose to provide as part of your application
9.4. Purposes of Processing. We use this Personal Information for the following purposes:· to assess your personal and professional capability and suitability for the relevant position;· to schedule an interview, if applicable· to open and maintain your applicant records· to communicate with you.
9.5. Recipients. We share your Personal Information with our third parties listed in section 7.
9.6. Retention. We will retain your Personal Information for the duration of the recruitment process. After the recruitment process and to the extent permitted under applicable law, we might retain your Personal Information for the purpose of offering you other positions, unless you notify us that you request the deletion of your personal information after we notify you that you have not been selected to the position to which you applied.
9.7. Your Rights. You may have the rights described in section 10 below.
10.1. General Provisions. Subject to some conditions and exceptions and depending on your jurisdiction, you are entitled to specific rights regarding your Personal Information. 10.5. In most cases, you can exercise such rights free of charge. 10.7. Subject to the provisions set forth above, you have the right to withdraw your consent to receive marketing materials, by contacting us through the “unsubscribe” instructions in the promotional communications you receive.
11.1. General Provisions. We may host, store, process, maintain or transfer the Personal Information to various sites worldwide, outside your jurisdiction including through cloud-based service providers, where the privacy laws may not be as protective as those in your jurisdiction. Where specific laws or regulations relating to data transfer apply to us, we will endeavor to ensure that the Personal Information is protected and transferred in a manner consistent with legal requirements.
11.2. Israeli Personal Information Transfers. When we transfer Personal Information from the State of Israel to a third country outside Israel, the transfer takes place on the basis of: (i) a country declared as offering equivalent level of protection by the Israeli Privacy Protection Authority; (ii) another approved transfer mechanism under the Israeli regulations; or (iii) your consent through this Privacy Policy to transfer your Personal Information to other jurisdictions, understanding that in some countries the level of protection may be lower than in Israel.
